Which System Are You In?

So many of us are looking for our own place.  Where do I fit into the big picture?

You fit in right where you are, and yes there are also other things you can be incorporating into your life to take us as a whole, one more step closer to achieving our combined goals.

When do I know I'm no longer in the Amelikan system? 

Well, you know that when they no longer have the chattel bond on you - that is when you no longer have a social security number.  As long as you have one, you are considered Amelikan, no matter how much of a lie that whole country is, or how much you don't like it.

There are ways however, that you can get what you need both within and without that system.  Let's take a look at what we are describing here:

Within the system - Since you have a social security number and if you have a job, it is likely that you pay taxes to Amelika, there can be no denial that you are in their system.  But you don't want to be in their system and it sucks that unless you are in their system, you cannot express your mana'o on matters that count to you as a sovereign, as one Kanaka Maoli.  What do I mean?  Well either you vote in their system or you sit back and allow their most horrible people get into a position of power, which can work against us as a people.  It affects everything around us as well as our quality of life.  

So what can you do?
  First of all, yes - you vote, you testify.  We need you to stand up and make our voices strong. Without you, my voice alone is outnumbered by others who wish to take control of our country.
  Second of all, you take those tax credits on your donations.  I don't know where you got the idea to not do that.  Have you spoken to the person who does your taxes?  Have you thought about what that extra money will do for both you and our lahui? You probably don't really understand where I am going with this.  Well, when you make a charitable contribution to a non-profit, they give you a receipt or you can take a screenshot if its online.  You save that with your transportation receipts & work clothing/supply receipts.  At tax filing time, you claim every tithing & donation and the federal IRS must reimburse you upto 50% of your gross income which means that you did not pay that amount of federal taxes this year.  Long story short, they won't be making bombs on your tax dollars, but our communities will benefit from all the new donations coming in, which will increase the way they serve our community.  
  Third but definitely your last option or area of opportunity to become more sovereign, is to make one small goal per month to do something for your community or extended ohana.  Maybe a beach day where you focus on the unity, instead of other things that distract us from spending quality time with our families.

Just because our kingdom is dormant, does not alleviate us of our kuleana to the kingdom.  They said until the last Aloha Aina - they didn't mean until the last time we laid down and did absolutely nothing about all the issues we complain over.  They did not say until we were pau pulling one another down in self-pride.  They said the last Aloha Aina... that includes all of us, not just the same dozen of people who are falling apart while trying to hold an entire lahui together.  Let's get off our asses, stop criticizing one another, stop with the immature bullying and gossiping, and do this together.

Kanaka Gardens

There are many benefits cited about gardening but perhaps the most appealing benefit to you and I is the amount of money we will save from groceries, and the fact that you can either share your excess for events and family or you can sell it at a local market for supplemental income.

Yesterday was a great time to start your garden, but today or tomorrow will do.  We don't want to find our families in a period of hardship, should that barge we depend on ever stop coming.  Would you be prepared?  How many items that presently come on the barge, can we manufacture right at home? 

Let's look at how much we can do with a small & simple garden:

Fruits:  you can use some, sell excess, share with family, make and sell jelly or dried fruit products, and make a lucrative income just on raw fruit sales.

Vegetables:  you can use some, sell excess, share with family, make and sell pestos and sauces for a great income

Herbs & Spices:  what you don't use, you can share with family and sell in markets, or make products.  Check in with your local kahu to see if they need any on stock.  They will be thankful 

Medicinal Plants:  for all other obvious reasons

If you have a chipper, you can contract that to people who are cleaning up their land, mix it with your compost or make bio-char to clean your aina.  No matter how you use it, you can make a decent living turning it into nutrients for the soil.

Perhaps its time for you to assess your garden and how you can save time & lawn mower gas by making edible landscaping, as opposed to the never ending task of cutting a hot lawn, getting sunburn and wasting money on upkeep that doesn't serve you or your family.  Let's plant seeds together.

Do you remember that video of Abercrombie in DC laughing about 200,000 acres of Hawaiian land that the state is benefiting from and not going to give up?

I honestly don't know what the point or goal of that meeting was, but it was one meeting I will never forget.  A friend invited me to the meeting where some uncles were supposed to shut it down.  I was asked to simply be there for the support in numbers.

I had never gone to one of these meetings before,  having been brought up in a foreign country and lacking the necessary federal blood quantum requirements to participate in such programs.  I really did not want to go to yet another function where I would be discriminated against.  It gets a little old after awhile.  That divisive mentality is not what our ancestors taught us to be like.  Even I know that, and I didn't grow up here.  So much for the stereotypes.

Not knowing what to expect, but knowing it wasn't my place to participate, I kindly did what any activist in my shoes would have done - resorted to journalism for this event.  So I pulled out my tablet as the meeting began and hit record.  This was definitely going on facebook, youtube, twitter and any other social media I could think of.

Danner opens the meeting with a theatrical performance where she wonders why so many Hawaiians are sitting on the waiting list for so long when there are 200,000 acres of unused homestead properties.  She goes in to describe how Kuhio set it up that there would always be something for Hawaiians and how Kuhio broke that ratio down.  There was so much for ranch, so much for residential and so much for mercantile use.  I began to notice circles in her explanation.  I wondered why it was getting fuzzy all of a sudden.

Spidey-senses alert, I listened very carefully and had to look at my friend next to me for confirmation that I heard her right.  She went on to dismiss Kanaka Maoli from ever applying for mercantile lands because they won't get it, or the chances are slim. The combination of Danner and Kauhane worked seamlessly to explain how too many Hawaiians fell non-compliant and that the ratio of non-compliant Hawaiians was 35% while non-Hawaiians were only non-compliant 21% of the time.

I jumped so fast that I almost fell out of my seat! Hand went right up..
I asked what were the numbers because percentage doesn't mean anything without true value of the numbers.  Another well known Wahine Maoli detected the east coast in my accent and hastily gave me the numbers, then asking where was I from and who are my parents.  She followed up her verbal two-piece by asking me what my blood quantum was.  Oh boy oh boy... here comes the distractions!  And just where were those uncles who were supposed to be shutting the meeting down?

Turned out that because the figures were low, there actual numerical difference was 9 non-compliant "Hawaiian leases"  as she described it earlier.  Without hesitation, I answered her questions while reeling that fish in.  I knew it! I smelled a fish.  "Born & raised in Philadelphia, 3rd generation gone since 1906 to the Maui family to which the last name goes back to 1528 as far traced.  12.5% and does that make me Hawaiian or not?  Because if not, I want a refund, take your 12.5% back.  If you represent what it is to be Hawaiian, I want no part of that.  But do you want to explain to the Hawaiians in the room how non-Hawaiians got on Hawaiian-only land in the first place?"

I could feel the electric level tension across the room.  I don't know if people were more mad at me for not being 50% and showing up (like be maha'oi) or if they were mad about the lies they were sitting through.  But the other wahine directed that anger right to me by telling me I had no rights to homestead and why always the haoles want what Hawaiians get?  Blood levels burst and two other wahine jumped up and announced their blood quantum as an achievement at me, while I told the first wahine to keep her Reservation land because that means that all the state land out there belongs to me and I have more options.  I also reminded her that if they truly wanted to eradicate Hawaiians, they would hit up the homesteads first because those are the only Hawaiians.

Ooh, she turned purple! Very nice, the way her colors blended to get that color.   But it had to be done.  I went on to tell her that I never saw her taking care of houseless kupuna, which are whom I am standing there to represent.  I don't want to live in homestead.  Here are some reasons why:
You have to let some federal entity micromanage your entire existence to get in homestead, then you are micromanaged and constantly help up to some other standard.  You constantly have to go to meetings where, if you aren't paying attention (like the good blood quantum people in this meeting) they are ripping you off at every angle.  If you are having financial trouble, you get evicted faster than in a home on state land.  Last but not least, your name is being used in their corporate misdeeds where they make all kinds of bad choices concerning our people, in your name.  No thank you.

The meeting was thoroughly in a state of civil unrest as the three women up front and I  in the back carried on.  I got emotional and told them all of this and how they are using innocent and unknowing people's names without permission, to commit hewa.  I reassured them I do not want their reservation but I will not sit idly where I am helping kupuna who should have something, suffer.

Somewhere in this whole thing, the uncles showed up and took it from there.  Danner & Kauhane were extremely upset to have been caught in their mischief and right when the uncles took over the fight, giving me a little rest, Michelle Kauhane's husband got emotional and closed the meeting down.  He was ready to physically fight.  The women were so red.

The lesson in all of this:  Blood quantum is a federally based method of division among our people. We have to pay attention to what they are really doing.  Remember that while you may have the blood quantum to qualify, your grandchildren mostlikely do not.  See how the rules have changed recently.  Notice that I never got an answer on how non-Hawaiians got on Hawaiian only land.  Notice how the smoke cloud put the focus on my being there, rather than to the issues at hand.  Not one answer was given, but the ugly in people sure showed.  What limelight does that shed?

How to Acquire a House via "Adverse Posession"

You might be asking what Adverse Possession is.  Let's give you the history step by step:

Have you ever heard of Squatter's Rights?  That is the beginning of home ownership through Adverse Possession, which takes just as long as a mortgage does, but for the most part, these houses are stuck in a long process and go forgotten until the process comes to a complete closure.  Then after that, many houses remain shells in slow damage.  Sometimes a squatter who improves the area is the best thing that ever happens to a broken home - empty and forgotten. Neglected and beginning to fall apart. 
Then you come along, with your ohana, and fix the house, love the house, bless the house and live in it.  The neighbors don't want to see you go! You've done so much work to that house! You get to stay, because of your rights, or be equally bought out at least for equity, maybe plus the liens you have paid, the pain of losing your home, + $20,000. Yep, demand the world for your rights.  Claim the Kingdom and the Kingdom will claim you.  This applies to your Kingdom (home) and your Kingdom of Hawaii. 

Squatter's Rights are the beginning of this phase and Adverse Possession is the ultimate goal.  Just know that everything you have ever documented as having spent in the house, is what you get back and a little bit more, if you are forced to go.  Liens, repairs, taxes... all of it!  So you still have something decent to look forward to.

The principle of adverse possession allows you to assume the title on a property if you occupy it for a certain length of time without challenge. To establish adverse possession of a home in Hawaii, you must occupy the home for 20 years, and that occupancy must be "actual, continuous, hostile, exclusive, open and notorious." "Actual" and "open and notorious" mean you lived there as if you owned the place, making no attempt to hide it and doing the things an owner does, such as maintaining the property and paying the bills. "Continuous" means you lived there the whole time. "Hostile" means you lived there without clear title to the land. And "exclusive" means the home was on private, not public land, and you didn't share the property with someone else who may claim title.

Occupy the home for 20 years in an "actual, continuous, hostile, exclusive, open and notorious" manner. You can assert an adverse possession claim to a property only once every 20 years -- so if you make such a claim and the court rejects it, you must occupy the home for an additional 20 years before you can try again.

Gather any evidence that supports the idea that you are the rightful owner of the home. Hawaii requires that any adverse possession claim be made in "good faith." That means you must have a legitimate reason to believe that you are the rightful owner. If you know that someone else has legal title to the home, yours is not a good-faith claim.

Prepare a "quiet title action." This is a lawsuit to establish your title to the home. If you know of another party asserting ownership of the property, your action will name that party as a defendant. If you don't know of anyone else asserting ownership, the lawsuit will simply ask the court to declare you the rightful title holder.

Go to the Hawaii Circuit Court for the district where the home is located. The 1st Circuit covers Oahu, and the court is in Honolulu. The 2nd Circuit covers Maui, Molokai and Lanai, and the court is in Wailuku. The 3rd Circuit covers the Big Island, and the court is in Hilo. The 5th Circuit covers Kauai, and the court is in Lihue. (There is no 4th Circuit; it merged with the 3rd Circuit in 1943.)

Go to the filing window at the proper Hawaii Circuit Court building and file your quiet title action. From there, the case is in the hands of the legal system. If the defendant, or anyone else, challenges your action, there will be a trial. If no one challenges, and the court concludes that you have a qualifying good-faith claim, you may get a summary judgment in your favor. If the court concludes that your claim is in bad faith, it may issue a summary judgment against you.

Now that we've given you our introductory statement and have cited its information source, let us get down to the nitty gritty of the situation.  

Where do you start with all of this? Can we get a breakdown of the stuff up there?  Yes we can.


First things first:  

• find out how and how long the house has been vacant and assess the neighborhood to figure what might be missing from the infrastructure.  Usually drug neighborhoods don't have any aluminum or piping, so right off the bat, you have a rough idea of what your looking into, although many places can surprise you.  
• look up the title work to the house.  Best to build a portfolio of the house and its situation, so surprises won't be as dramatic. Always assess the total amount of liens on the property.  To make it yours, paying these liens is part of the process.   
• see what the neighbors tell you.  Make notes when you finish meeting with them.
• Assess how you will get into the house, and you will have to be able to re-secure the house upon exit.
• Bring cameras and take as many pictures as you can get while looking around.

When you go home from viewing and pic snapping, grab a snack and sit down to write what's fresh in your mind.  There will be a lot to remember.  Slowly go through the pictures, and do your research on how many resources you have to help you and what supplies will cost you. Write down a rough estimate and sleep on that. Make your decision the next day.  It gives you plenty of reaction time to something that might bother you later.

If you are moving forward with it, this is where you begin:

• print yourself a lease so that you will be able to get utilities and such.
• Make a photo album/scrapbook for the house.  It will come in handy later, for everything regarding legal stuff for the house.
• Call all the agencies and poke around with questions regarding the debt and how to handle it.  The big question is what are you liable for, in order to completely own the house.
• Make a binder for all house related information including bills, payments, receipts.
• Get a receipt book and have those who help you, write charges for the help they've given.  This is home equity, you know.
• Have someone who cannot do much physical labor, be the secretary of what's getting done to the house, while everybody else does the work.  That person will be able to keep more accurate records, as they can focus on the writing and picture taking. 
• Do all the work you will need and move in right away.  This secures the establishment of your presence.
• Continue to make improvements, as you can afford them and make sure the house appears better than before.  This will ensure that the neighbors will have your side in any future legal battles that may or may not occur in regards to the house.
• Always take pictures before and after everything you do.  The proof is always in the pictures.
• For everything that you do to the house, make sure you do background research on the house as well as the project itself.  You do not want to do something that is going to end up a waste of your time and efforts.  
• Always stay on top of the structural necessities, as they are most important to not only your family, but to the record keeping of the house.

If you can follow these simple instructions, you should have minimal issues and maximum success in complete ownership of the said property.

What is the one thing that everybody wants?  ok.. besides prove that they are the next king or queen?  We all want the de facto to go back where they came from, right?  Well, meet me down at the palace on September 2, 2013 and we can discuss that.  Yes, the march to the state building is one of the activities, but most of all, where we, kanaka maoli can join together and be educated and as to what the deal really is and make our Voice known! Let's say this together now, "I am Sovereign unto the Hawaiian Kingdom."  Let's do it again; I want to hear you in my na'au.. "We are Sovereign unto the Hawaiian Kingdom."  Who has the clear land titles?  The Hawaiian Kingdom! Who has that real money in the bank?  Our beloved Queen! The Kingdom! Not the US who will always be slave to the IMF and war. Did you ever see their track record?  Here, I'll show you.  This is sick.

We don't have to get bombed in the name of American attacks on other countries.  They are sick and have taken this manifest destiny thing too far, and its time for us to see that we are a sovereign people and for our friends to know that their lives would get a whole lot simpler if the de facto were removed.  Nobody who lives there would be violated in any way shape or form, except to say that your bills would be a whole lot cheaper.

We wouldn't allow corporations like Monsanto on our lands, life on the islands will soon be sweet again.  Have you ever seen the picture of the Monsanto dust storm?

Well anyway, the DLNR is threatening to bulldoze the Gardens at the statue in Hilo,  and support is needed tomorrow and throughout the week.  Come camera ready!

The Voice of the People is a chance for us to get together and hear what our leaders have to say, learn what we haven't already learned about our history and prepare ourselves for the manifestation of our Kingdom's restoration.  It is here, that we will all come together to get on the same page.  Remember that anything is possible when one believes.

Our objective of this event is to move forward with our common goal of decolonization of the illegal occupation.

From point A-havoc to point B-spiritual flow:

The main thing we need to begin this process of fulfilling the heirarchy of needs is to fulfill physiological needs. This includes giving our people the voice they have been stripped of for so long. Once a mass healing, blessing and ceremony is done, it will send our kanaka back home with a sense of safety and security. Now that we have safety and security, we will develop a deeper sense of recognition, which will ultimately build our self esteem and bring our kingdom into self actualization.

Keeping ourselves motivated isn't always easy with all of the daily pressures that we go through.  Life can even be outright discouraging at times.  When we come together, so do our ancestors, keiki, mo'opuna and hearts.

Our attitudes can influence our behaviors and make a huge difference in the outcome.  

Active listening is necessary to gain a full comprehension of what is being presented to us.

Being able to visualize together can only make us move forward with a sense of harmony.

United, we stand a much stronger chance of completing our kuleana as a people.

This gathering isn't a concrete establishment - it is a time where many of our people will come together and we will listen to all leadership educate us, music, ho'oponopono with one another - unify. We want people to come out with their organizations and tell the people what they are here for and the reason for the paper is so that history doesn't repeat itself. We're not writing the constitution, we are saying all the things that need said before it is written.

• Whereas, Kanaka Maoli have repeatedly protested the Unlawful Annexation to the United States, since the Ku’e Petition and through actions prior to and post annexation.
• Whereas, Kanaka Maoli are sovereign to the archipalego of Hawaii Nei and are bound to protect persons and property of his subjects, and to defend them against the enemy.  
• When therefore, a subject or any part of his property, has fallen into the enemy’s possession, should any fortunate event bring them again into sovereign power, it is undoubtedly his duty to restore them to their former condition - to re-establish the persons in all their rights and obligations, to give back the effects to the owners; replacing everything on the same footing on which it stood previous to the enemy’s capture.
• Whereas, the justice or injustice of the war makes no difference in this case - because it is a national concern.  The subjects suffering at the hand of the enemy shall be restored to their inherent powers, to the hands of their own people.
• Therefore, let it be resolved that there is nothing more natural than restoring the inherent sovereignty of the original people of the land, as soon as it becomes possible.  There is no justifiable reason it wouldn’t be possible.
